1. Acceptance of Terms

By accessing or using AAA Relay TMS (“Service,” “Platform,” “Software,” “we,” “us,” or “our”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service. These Terms apply to all users, including carriers, fleet owners, dispatchers, brokers, drivers, administrators, and authorized representatives.

2. Eligibility

You must be at least 18 years old and have authority to bind your company (if applicable). You agree to use the Service only for lawful purposes.

3. Account Registration

You agree to provide accurate information, keep credentials confidential, and are responsible for activity under your account.

4. 14-Day Free Trial

We may offer a 14-day free trial to new customers. The trial begins on account activation and may include feature or usage limits. Only one trial per user or business entity is permitted. At the end of the trial, your account may be restricted, suspended, or downgraded unless you select a paid plan. Trial data may be retained for a limited period and then deleted. We reserve the right to modify or end the free trial at any time, including where fraud or abuse is suspected.

5. Subscriptions & Payments

Paid plans may be billed monthly or annually. Fees are non-refundable except where required by law. You are responsible for applicable taxes and third-party charges.

6. Acceptable Use

You agree not to: violate laws or regulations (including FMCSA/DOT requirements); use the Service for fraud, misrepresentation, or prohibited activity; interfere with security, performance, or availability of the Service; reverse engineer, copy, or exploit the Platform except as permitted by law; upload malware or harmful code.

7. Compliance Responsibilities (FMCSA / DOT)

AAA Relay TMS does not guarantee compliance. You are solely responsible for maintaining valid operating authority, registrations, insurance, and permits; driver qualification files, licensing, background checks, and training; Hours of Service (HOS) compliance and recordkeeping; safety policies, maintenance, and incident reporting; and accurate documentation (rate confirmations, BOL/PODs, invoices, settlements).

8. Data & Content Ownership

You retain ownership of your business data. You grant us a limited license to host and process data solely to provide and improve the Service. We may generate aggregated or anonymized analytics that do not identify you.

9. Intellectual Property

All software, branding, UI, and documentation are owned by AAA Relay TMS or its licensors and protected by law.

10. Suspension & Termination

We may suspend/terminate access for Terms violations, non-payment, or suspected fraud/misuse. You may terminate at any time.

11. Disclaimers

The Service is provided “AS IS” and “AS AVAILABLE.” We disclaim warranties to the maximum extent permitted by law.

12. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect or consequential damages. Total liability will not exceed amounts paid in the prior 12 months.

13. Changes

We may update these Terms. Continued use after updates indicates acceptance.
